LORAIN — A Lorain councilman said Monday he’s tired of hearing about wrongdoings by Lorain police, and he wants Chief Cel Rivera to deliver some answers this month.
Councilman Dan Given, D-at large, told City Council Monday that he was concerned with the recent misconduct by some officers and he ultimately holds Rivera responsible.
“When you have major components of your team being accused of committing crimes they’re supposed to police, something needs to be done with the overall structure of the organization,” Given said after the meeting. “We’re at the point where we cannot ignore it anymore.”
Given requested that Rivera and his key personnel meet with the council by April 28 so the city can work to realign the department’s focus before an increase in warm-weather crime begins.
He said concern expressed to him by residents fueled his call for the meeting and is the driving force behind much of his concern.
“We’re letting residents down,” Given said. “There’s a lack of trust on the streets that needs to be addressed.”
Rivera couldn’t be reached for comment after the meeting Monday.
Safety Director Phil Dore said he thought a meeting with Rivera would be a positive one and provide city leaders with an explanation of what the department’s doing to make the city safer.
“(Given) is concerned about the credibility of our police officers — most of which are stellar guys,” Dore said. “I think Chief Rivera would love to come in and address any of council’s concerns.”
Dore added that a recommendation from the disciplinary hearing of Officer Emilio Morales could come soon.
Morales — the most recent officer to find himself in trouble — was investigated last month after deliberately dumping two guns given to him into a city sewer. He remains on duty.
Before Morales, the actions of embattled Lorain Officer Corey Earl were being scrutinized.
Earl served a three-day suspension last week after an internal investigation determined he violated department policies earlier this year.
Earl broke the rules when he entered Scorcher’s bar on Jan. 30 while he was working to wish a woman he knew a happy birthday, Rivera said at the time.
Department rules, however, prohibit officers from entering bars without an official reason while on duty, Rivera had said.
Rivera also said Earl committed conduct unbecoming of an officer when he complained to three sheriff’s captains about the behavior of a corrections officer he saw while at Scorcher’s. The corrections officer had dated Earl’s former wife.
According to Rivera and the paperwork regarding Earl’s discipline, Earl asked the captains: “What’s it going to take? Am I going to have to take a baseball bat to him?”
In addition, suspended police officer Stanley Marrero has been accused by two women of sexually assaulting them in 2006 and 2007.
The two women have since filed separate lawsuits U.S. District Court and are asking for a combined $30 million from Marrero, Rivera and the city.
Marrero is awaiting trial on charges of theft in office, menacing by stalking, intimidation of a crime victim and public indecency charges.

Why should the Chief put it all out there? You just did, or at least tried. You state that Jack Brown blew well over the legal limit…what was it smarty pants? I know and it was not over the limit. Even if Brown (who is a great guy and doesn’t deserve the treatment he got, but where were you then) was a little over or a lot should he be on duty. I think not. I’m not critizing him dear sir or ma’am just stating a fact it has been allowed to go on and on now the chief wants to do something about it, if he is going to throw some people under the bus then he should through all, OR KEEP IT IN HOUSE. You must be one of those people that gets their way there so of coarse you don’t want anything negative said. The free ride for you may soon be over then what?
I didn’t say Biaz went out of town with some bad people. I said if you are going to get judged for who you hang with then everyone should fall under the same spot light.

Every person on here has been talked about in the public, at the schools, and in the street, it just seems that if you are liked by these so called high ranking officers you’ll be fine if not well.
I have worked in the system along time Blade and have seen many things and fairness has never been one of them. You may see at some point and i will feel sorry for you. But leave me alone, stick to you own opinions. If I’m wrong then just say it and let the public figure it out, but don’t attack me.

In my opinion, Cel is doing a great job. Jack has had drinking problems for years, which go back to when he shot those street lights out in Amherst Township 18 yrs ago. Further, he almost attacked Cel when he was drunk, and the FOP President. As for Super, he was only straigtening out a troubled teen with a witty mouth last year. Davis is the one who made a big deal outta that incident. In fact, Dennis had his own demons too with alcohol. Toothman has been caught twice with OVI’s. Stan, is a cry baby, who needs to take it like a man, along with Emilio. Keep up the good work Chief!!!! You Rule!!!!

Its obvious to me that both of you work at the police dept and arent the greatest of spellers (unless thats the intention here). Perhaps all the gossip spreaders within need something else to do with their time and let the chief fall on his own as he seems to be gradually doing. If you look at all the officers that have been busted in the last few months, you will find that they are all veteran officers that still think the old way of doing things is ok.
Since when are extra marital issues a departmental issue? If they are having problems, then it shouldnt be anyone elses business. Granted it may be talked about within the workplace, but it still doesnt make it a dept issue.
What exactly is the legal WORK limit for alcohol?? Its different than the legal limit isnt it? Im sure either way its wrong, but then again that isnt your business either, is it?
oh, and lastly….. its spelled BAEZ…. but I think you already know that and want to make your comment sound like that of someone who has no ties to the police dept..
If you dislike your job that much, that you have to bad mouth it whenever possible, perhaps you should look for other employment or retire all together.. People like you dont make it a favorable place to work for those who do like that job and want to make a career of it.

It seems that Patrolman Brown blew enough to warrant him sitting at a desk. Until an “investigation” is completed.
The fact that he was made to blow is indicative of the accuracy of the charge made against him, from a citizen, while on a call.
How often does an officer request an impaired driver to submit to a breathylyzer, and it comes up .00? If they made him blow, they must have agreed somewhat with the complaintant.
The citizens of Lorain deserve to have an officer respond to a call that has ZERO alcohol in their system.
The man is driving a police car, potentially at high speeds and carrying a weapon for crying out loud.
This is not the only alcohol trouble Patrolman Brown has been in recently.
If he had been convicted of domestic violence 2 years ago, he would never be allowed to carry a weapon…again.
There is a PATTERN of whatever you want to call it, poor behavior, bad judgement, illegal activity. Whatever the case, the citizens feel a change may be warranted.
If a large number of employees in a business are performing poorly, then one must examine the source of the problem.

Chief Rivera, in his past deeds and actions, has fostered a mentality of “we’re teflon, we can do what we want with impunity”…and it’s catching up on him, the department and the city of Lorain.

Does it really matter what Officer Brown tested? In the State of Ohio, you can’t be in possession of a firearm if you are under the influence of ANY alcohol., police officer or not. According to the Ohio Revised Code, he committed a Felony.

I would like to just say that I’m not trying to be personal it is just that if you are going to have double standards it isn’t fair. If Stanley had a issue with a crazy woman and it was splashed all over the paper, then when the chiefs girlfriend came to the station last year ( I think it was last year, check with blade) and made a scene in the lobby, why wasn’t that addressed? If Jack has gotten away with this for so long how can you punish him now? Where is the fairness here? Just for clearification Jack was drinking the night before not at the job.

Here’s a thought! don’t break the law like Emilio or Stanley, and Lt. Rohner won’t have to an investigation. These two officers got away with quite a bit over the years. They forget that a Captain at the SO recommended leniency for one of them back in 2000. Dennis Will needs to do the right thing, and indict Emilio, and re look at Stanley’s case, and put some more charges on him.
Also, making fun of ranking officers in an anonymous letter, is juvenile. Attacking one’s manhood is wrong!! Those officers have families too, and unblemished careers unlike Stanley and Emilio. As for Jack, this has been long overdue. There is now way, I would want him backing me on a call.
You guys owe the Chief. At least he’s showing mercy, by allowing some of you malcontents administrative leave, rather then firing you.

You people are crazy to think these things won’t happen to you. I don’t believe that there are more than a handful of people in that department that haven’t done something if the chief or Rohner wants you bad enough they will find something. That is how he got Morales, they had to dig for quite sometime but the finally found something. And some of these investigators are suppose to be his friends, Ha that is a joke. You learn real fast who you can trust.

Hmm!! That tip from a drug investigation, didn’t fall outta thin air. My next question is. If I were going to tamper with evidence (destroy it), or committ theft in office. I wouldn’t put the guns in a plastic baggy for future recovery. I would dump them in Lake Erie or the Black River. Also, I wouldn’t be hanging out with drug dealers who are under watch. As a cop, Emilio wasn’t too intuitive about his surroundings. Think, he would notice his co workers from afar. Much like Wayne Long, when he hit on Mindy Reiber as a decoy.
Emilio, has always cut corners. I had some experiences with him, when he was a CO, after he got outta the Air Force. Officers had misgivings back then about him. He should of been canned with Coonrod.
I think a few bad apples don’t spoil the apple cart. The Chief took care of these two officers for years. Now, they spit venom in his face. Further, Rohner has always been fair and objective, even when he handled Super’s incident a year and a half ago.
I know it’s rough to indict a cop, but I pray Will does the right thing and takes these problem officers like Stanley and Emilio off the streets for good.

formemo !!!! That little tiff between the chief and his friend occurred almost 6 yrs ago. From my understanding, Janice, Shirley, Wayne, and Jessie were there. If there had been a serious problem, I’m sure something would have been done. Quit making something outta nothing.

Such risky comments posted under this topic lately. I thought the article said Dan Given called Cel Rivera out; questioning him about the behavior of his officers. I didn’t think he did this on his own.
I do recall Cel recommending the firing of officers who erred in the past and agree with his statement that they are protected by the union and through arbitration they get their jobs back.
Clearly, many who have posted comments know a lot about the history of these officers and Cel, and I question how that is. Was it all in the news? Are you directly related to these officers? Or, do you work in our police department or city? My last question concerns me the most because such comments can add to the embarrassment we as the citizens of Lorain are already enduring.
More importantly, employers around the country are taking an aggressive approach (firing and suing) against employees who smear their co-workers online or post, in length, incriminating information about someone. It is so easy to track those who left such comments, and where free speech can be argued, to incriminate someone is illegal.
I truly hope those who comment do not work for the city of Lorain because the door is now open for more embarrassment on our city as heads begin to roll.

You speak so highly of Rohner, is this the same Rohner that allowed his detectives to get addicted to drugs and wasn’t punished? There has been far to much corruption in that police department and it is very sad that you are all so divided. You should be standing with one another not higher ranking versus street patrol or Cels boyz. Come on grow up. I know many of these officers and i can tell you that none of them are bad. Emilio has always been good for and to the community and I don’t understand why You his fellow police officers would talk negative about him. If he was a bad officer why haven’t we heard anything negative until now? I agree what was done is bad but not unforgivable. I don’t think one mistake should make or break a person. Clearly after sixteen years you must feel the same. It is clear that there appears to be alot of mis deeds going on in that department and if you are going to be fair then either you need to go back a fix all the wrongs or start fresh, everyone even the chief gets a clean plate.

I just read in todays paper how City Council does not like the way Given asked for answers from the Chief. I can’t believe that council still defends this guy(chief)even after he pulled the wool over their eyes and created the Sgt position for McCoy and said it was an emergency and McCoy is still in the DB doing the same work(or no work)but now is getting Sgt. pay. Does council not realize that they were duped?

Kudos to Chief Rivera and Lt. Mize for both working together and finally putting an end to Ptlmn. Toothman’s gross abuses of sick time. This will be a lesson for other officers to follow.
Now, next on the list, is to have emilio indicted, for his wanton misconduct and the embarrassment he has put on ur city,the department and the Chief and his command staff who have worked so hard to make us one of the most progressive departments in the region.
I am proud of the Chief and Rohner who are both setting a precedent for police reform. They are finally ridding the department of its cancer.
If Emilio, Stanley, Jessie, Toothman, and Brown had followed what Rivera and Rohner had personified the whole city would be in a better place.
Rivera, has always been fair with everyone, when it came to discipline, and if anything, he was like aparent, who mades some rough decisions in our upbringing, but we all grew under him.
Chief, I know people are pushing for you to retire. Please, don’t. Over the years, I admired you, learned from you, and benefited from your teachings. You are the father I never had.
I can’t think how many times when coworkers of mine had family problems, and you were there for the men, spouse, and kids. Cel personally made calls, to them at home to lend support, which was appreciated. He was the first one at St. Peters church, to sit in front, volunteer to help the kids, with activities, and convey to them, what it’s like to be a real catholic. You also did quite a bit for the Lorain city schools as well. Over the years, when Malinovsky was Chief, it was apparent, that he needed to go, you took over many of his responsibilities, and worked behind the scenes to make LPD a better department.
You will always be my Chief.

Stop acting like you don’t work for the chief. If you want to talk about embarrassing lets talk about how the LPD loves scorchers. They should not even be allowed in that establishment. Isn’t that were Earl threaten someone and one of your detective was in the restroom with another detectives wife? Glory and Silent Pardner! Sounds like you both have problems with Rohner and the Chief! Sure, the bible does not allow infidelity, but the Chief is in a delicate situation. Gladys does not want to give him a divorce, so she can take half of his pension. You tell me, what he is supposed to do? Walk in his shoes for a day. The man is a great father, and grandfather. Do you realize that he is paying for the bulk of his daughter and granddaughter’s care!!
As for Rohner, and the bit with the olympics. That was just a friend, whom he hung out with. In fact, they had seperate rooms. Did you have a female friend before, to bounce your thoughts around with. That relationship was strictly platonic.I have lots of female friends, whom I never had physical relationships with.
Now, getting back to Stan. That man was married, and seriously broke the 10 commandments. Thou shall not covet thy neighbors wife . If one sins in one way, they sin in other ways.
Also, the community, the media, and leaders wanted sacrificial lambs. Jessie, Stanley, Morales, Toothman, and Brown, all stepped up to the plate. Thanks guys for helping the cause! Let’s be honest, the Chief is doing a public service. He’s finally ridding the community of officers who have effected the credibility, and integrity of LPD for years.
Best, thing for you guys to do, is take a deal, plead out, go to prison, come out, and get on with your lives. If you guys go down quietly, I’m sure the Chief will recommend leniency for all of you. Oh!! by the way, no one is going to step up and do a vote of no confidence against the chief, if they value ever retiring from LPD.

Just curious on your thoughts about the Chief going to Council and saying it was an emergency that they get some new Sgts, just so that he could promote McCoy and then keep him right where he has been for years. Was that fair to other guys that were waiting for the list to expire so that another test could be given. This is just one example how he takes care of the suck asses in that department.

i don’t see anything wrong with that at all. Do you realize that when Mark too his civil service test, he was #1. He also, did a allotta follow-ups, on calls when he first came on, to prepare himself for detective, and took Chuck Shuster’s place, as auto theft detective, with less then a two years on the department.
I think the Chief did the right thing by getting him his stripes. Hey, if you guys had worked hard like Mark, you would have gotten unlimited OT, and a coveted detective’s position too.

There was no humor in my post, but love and respect for one of the best auto theft detectives Lorain ever had. Do you realize Mark is a devoted family man, and Catholic like the chief? Also, Lt. Rohner went to the Old St. Mary’s (Lorain Catholic) as well. Being a Catholic Rules!!
Lt. Rohner is everything a Catholic should be. He has a great work ethic, he’s athletic, a sharp dresser, and conveys himself in a positive manner. I am so proud of all these guys. I look to Lt. Rohner, and the Chief as my role models, and you guys should too.

Did anyone read the Plain Dealer article today in the Metro section? I found it disheartening, the way the chief was portrayed. But, it was nice to see the Safety Director sticking by him. What did you guys think of the article?

I would really like to know what the heck being a Catholic has to do with being a good police officer? I was raised Catholic and I don’t recall any of the religion’s tenets or dogma stating that I had to be athletic, a good dresser, positive, or even have a good work ethic. It was more focused on my relationship with God and following the religious rules of the Church.
I also wanted to know where the exception was for breaking of the 7th commandment? I was truly unaware of the fact that if your spouse refuses to give you a divorce it was a pass to commit adultery.
Just wanted to point out that I could care less who slept with who or did what with who. I just wanted to address the silly religious comments that were thrown in there.

Just to clarify your opinion Officer Marrero and Melba have been legally seperated for the last 6 years. She too would not give him the divorce because of the kids, they wanted to wait til they graduate which is actually in a month. The divorce decree has already been put in motion and should be done by the end of the summer. Who are we to judge anyone’s marriages? It takes 2 to make the work & 2 to brake them as well. Also, for your clarification I have never been married nor intend to do so. There should be a rule if you are a Lorain City Police Officer you shouldn’t be married. Rohner dressing sharp, being athletic, and conveying himself in a positive manner is a BS front for I will cut your balls off later. U obviously work in the department somewhere high on the food chain. The way u place the chief & the Chroner on a pedastool. The Catholic Church which I am also shouldn’t be brought into this discussion, making yourself appear to be a good catholic when really u are not how should I say this practicing to be a good catholic are 2 totally different things. Providing for your family doesn’t justify weather you are a good person or not, Scott Peterson was a good provider until he wacked his wife & unborn son for his mistress. The chief things by cleaning house now it is going to change everything make all the bad things that have been go away and it won’t. The best thing for him is to retire and take his next 6 in command with him and let the department start over.

It seems like every time I say something good about management, you guys tear me down. Obviously, you guys are disgruntled. But, my perspective has been completely positive.
Over the years, i worked hard, and was given good things like a take home car, special duty/assignments, and extra overtime, to enhance my lifestyle and pension. I had to perform in a good manner to get these things.
Rohner, and upper management all worked hard for the chief, and deserved everything they got. When was the last time, you said hi to these guys, or showed initiative in front of them, to get noticed?
Also, Emilio should be happy that the chief only gave him 48 days. He should have been fired. But, Dennis Will still has his case, and could do something totally different. I hope Will sends Emilio to jail for a long time with his friend Stanley. Those two owe the Chief, and they should appreciate how he has treated them.
Recently, the Chief implemented new policies on gossip and making fun of coworkers. Hopefully, this will stop malcontents from going to the media and two grandstanding politicians spreading lies about the chief and those who work with him on a daily basis.
Silent Pardner, the best thing for the chief to do, and upper management, is to ride the storm out, and stay a few more years, and clean this department up like they are doing now. As the Journal said, the Chief is doing a good job, and I agree.
