Man sues wife for allegedly shooting him

ELYRIA — An Avon man whose wife allegedly shot him four times as he slept is suing her for more than $25,000 in damages.

Herminio Carrasquillo filed the lawsuit against Pamela Carrasquillo on Thursday – despite the fact that the couple’s divorce is still pending – because the statute of limitations was about to expire, said his attorney, Matthew Hallett.

In Ohio, victims of alleged assaults have only one year to sue their attackers. The anniversary of the shooting is today.
Pamela Carrasquillo, 52, is awaiting trial on criminal charges of attempted aggravated murder and felonious assault in connection with the Jan. 4, 2007, shooting.

Avon police reported that Herminio Carrasquillo called 911 about 3 a.m. to report he had been shot four times in the chest, arm and leg. He originally identified his wife as the shooter, saying he had seen her face in the glow of the gunfire, but he quickly changed his story. In March, he again told Avon police that it was his wife who had shot him, saying he’d lied to protect his children.

Hallett said even if the divorce proceedings award some of the couple’s property to Pamela Carrasquillo, her husband could ultimately get the property back if he wins the lawsuit against her.

There isn’t much chance of reconciliation, either, Hallett said.

“I think the fact that they’re involved in a divorce, and he’s pursuing civil action against his wife speaks for itself,” Hallett said.
