LORAIN — A 30-year-old Lorain man is in jail on $100,000 bond after being arrested early Monday morning on charges of rape and kidnapping.
Tracey Henry Hale allegedly dragged the 20-year-old Lorain victim from her friend’s car to one of his friend’s apartments in the 1000 block of Oberlin Ave.
A man, Daniel DeMarco, 40, let them inside and Hale then raped the woman in one of the home’s bedrooms.
According to the police report, the victim was at her residence, had a fight with her roommate and asked a friend to drive her to her family’s home in Elyria. Hale also got in the car.
Instead of taking her to Elyria, the friend drove her to the area of West Eighth Street and Oberlin Avenue, saying he had things to do.
Hale got out of the car and dragged the victim with him, Sgt. Mark Carpentiere said, adding the driver left the scene.
The victim began screaming for help and was told by Hale to shut up, police said.
Hale knocked at one residence and when no one answered the door, he knocked at DeMarco’s apartment and was let in.
The victim told DeMarco she wanted to go home and asked him to call police, but the witness “just stood there while Hale pulled (the victim) to a bedroom,” a police report read.
Hale then raped the woman on a mattress on the floor of the bedroom while he covered her mouth with his hand because she was screaming for him to get off her, the report read.
The witness told police he heard the victim, whom police indicated smelled of an intoxicant and had slurred speech, yell “Get the f— off me!” repeatedly.
After raping her, Hale got up and ran away, the victim told police. The male witness claimed he went into the bedroom and told Hale to get off the victim, although the victim claims the witness did nothing until Hale had already fled the residence.
During police interviews, the victim had to be secured in a cruiser for acting aggressively to-ward the male witness and telling him the assault “was all his fault.”
“The case remains under investigation,” Carpentiere said.
Hale’s preliminary hearing has been scheduled for 10:30 a.m. Tuesday in Lorain Municipal Court.

Whether or not, alcohol, drugs or any other chemical may be a cause or encouragement for a sexual assault, the simple utterance of the word, NO, must be enough to end the action.

You are 100% correct. No means no, plain and simple.

Hopefully there will be more arrests, “friend” and “witness” need to go to jail too.
