Wellington Manor faces foreclosure suit

ELYRIA — A Florida loan servicing company has filed a foreclosure lawsuit against the former Wellington Manor Nursing Home and its owner and administrator, Kay Justice, saying it is owed $163,267 plus interest.
The lawsuit, filed by Bayview Loan Servicing LLC of Coral Gables, Fla., also asks for payment of 11.75 percent interest between Aug. 1 and Sept. 21. It seeks interest at the rate of 21.75 percent after Sept. 21.
The suit filed Monday in Common Pleas Court states that Ewers-Bogojevich & Co. and the county treasurer also may have or claim to have an interest in the property at 116 and 120 Prospect St. in Wellington. The U.S. government also has or claims to have an interest in the property through a federal tax lien, according to the suit.
The nursing home, which had 13 of its 16 beds filled, closed suddenly over the summer when Justice left town, leaving a note referring to personal issues.
In February, the estate of Michael Zayatz had filed a lawsuit against Justice seeking payment of $59,000, according to court documents.
Between October 2006 and March 2008, Zayatz loaned Justice $63,000 and she paid back just $4,000, according to the suit.
About two dozen employees worked at Wellington Manor, which served 13 people with developmental disabilities and Alzheimer’s disease, and elderly receiving rehabilitation services
A spokeswoman for the law firm representing Bayview declined to comment on the suit.
