ELYRIA — Convicted child molester Joel Covender continues to seek vindication.
In a motion filed Wednesday in Lorain County Common Pleas Court, Covender requested a new trial contending his attorney was denied records that show his former stepdaughter, who accused him of molesting her in 1994 when she was 7 years old, lied. The woman, who now says she was lying, supports Covender.
“The fact that the trial court excluded these records after its inspection constitutes an error of law,” Covender attorney W. Scott Ramsey wrote in the motion. “The fact that (the woman) has a problem with lying according to her counselor constitutes new evidence.”
The 9th District Court of Appeals last year upheld a county judge’s decision not to grant Covender — convicted of molesting the former stepdaughter and a former stepson — a new trial. Covender served 11 years before the former stepson in 2007 said he made up the allegations.
