Parents of boy injured by utility vehicle sue LMHA, employee

LORAIN — The parents of a 6-year-old Lorain boy are suing the Lorain Metropolitan Housing Authority and an employee after the employee allegedly hit him with a utility vehicle.

Roylewis Anderson Hisle, 6, was a pedestrian at 2320 Westview Court when he was struck by a John Deere Gator utility vehicle driven by Lorain Metropolitan Housing Authority employee Danny Duvall, according to the lawsuit filed Friday at Lorain County Court of Common Pleas.

The lawsuit, filed on behalf of Hisle’s parents, Christine Robertson and Raymond Hisle, by attorney Mike Duff, contends that Roylewis “suffered injuries to his face, arm, buttocks, post-traumatic stress disorder, abrasions, back and other bodily injuries all or part of which may be permanent.”

The lawsuit alleges that Roylewis’injuries were caused by reckless driving by Duvall because he failed to maintain control of the vehicle and to adequately check blind spots behind the vehicle. Roylewis required medical treatment as a result, according to the lawsuit.

Homer Virden, executive director of the Lorain Metropolitan Housing Authority, did not comment on the lawsuit, referring questions to the agency’s attorney, but he confirmed that Duvall is still an employee.

Dennis O’Toole, the agency’s attorney, said he had not received a copy of the lawsuit, but he was aware of the incident, which occurred Nov. 18, 2011.

“We have had no information about this matter since then,” he said.

O’Toole added that there is a two-year statute of limitations for filing such a lawsuit, which he said likely was the reasoning behind the lawsuit, filed three days before that deadline.

According to the lawsuit, Roberston and Hisle are asking the court to award compensatory damages exceeding $25,000, plus interest and other costs.

          I filed a police report and was at the station for. A month and we have been in contact with them! And ##3 check two years ago I’m sure it was posted then. The lawyer waited until the last min not me!

            If they feel they got no case, they do as little as possible, just going through the motions and hope for a miracle settlement without going to court.

      This is his mother and he was ran over in his own yard two feet from the porch.. And he left the scene. But they claimed it to be privet property && that’s the only reason their were no criminal charges. So yes. It was his fault .

          And.. They let him leave the scene with out a breathalyzer or a blood test he left from the scene on the dam gator. It was like. A movie or a nightmare. We are not money grubby people what are we supposed to do?

            He should have been treated like anyone else with a motorized vehicle, if I drive in a yard with my car, they can sure make me take a DWI test

        If someone injures a person or causes great property damage on private property in Ohio, then leaves the scene, as you said, they are in violation of the law and will be charged. I mean, unless the cops seriously messed up AND you have one really bad attorney!

          Right… That’s why I was at the police station for a month straight looking for answers. They stated if it would have happened in the street the could have charged him with multiple charges. But because I was at the time living in public housing they are Claiming it was privet property. And they (police) said that you are able to leave the scene of an accident if you come back with in reasonable time…. Witch I think is bs because he could have stashed anything. && he had just ran not hit completely ran a 4 year old child over. It is fishy and that is why it is a “Torts” case and not civil . We had to get the case to a judge out of Lorain city. Because of coracle he works for the city so why… Would they persecute their own.

            Either the lawyer you saw the day of the “accident” isn’t doing his job at all…

            or

            You’re trying your darnedest to make a buck off of a simple, innocent accident, even if that means convincing your kid that he really does have permanent injuries, PTSD and the boogie man is out to drag him off to hades, just in case you need him to testify later.

            BTW… You didn’t address, why you would ignore your motherly instincts to remove your children from a dangerous situation… BECAUSE A DRUGGED UP DRUNK reassured you that all is cool!

            My child would not have been out their with out one of us and not at all if we were not on our way to bring food tiger greaving family. And if His gator was started they wouldn’t have been out. Even in my yard

His f**ing father was their tried to stop it when he screamed “dude your runing my son over” he Danny looked down at Roy in between both sets of his tires he did not get off and help pull him out instead he pressed the gas again finished his job then left the scene. So toe and any sain person would think that’s enough to make him blo . Your ignorant! Just to let you kno!

          Sorry Toots, but setting fire to an apartment, then blaming it on a kid, after you had time to think about it, does have something to do with this. It shows a pattern of a non-attentive, or possibly negligent parent.

          You stated that you believed your children to be in danger, yet did NOTHING to remove them from that danger, because someone you described as a drugged up drunk reassured you that everything was fine.
