High school teacher resigns amid allegations of inappropriate conduct

ELYRIA — An Elyria High School science teacher has resigned amid allegations of inappropriate behavior with a female student.

District officials said nothing sexual happened between the 14-year teacher and the student, but the incident was the latest in a pattern of incidents that date to 2003 and have been documented by the district.

David Richardson, 51, of North Ridgeville, resigned from his teaching job in a letter dated Jan. 30. In the letter, he said he was taking another job.

“I have a job opportunity that I cannot pass up,” the letter said. “I have enjoyed working with the students, staff and Elyria community.”

The Elyria school board accepted the resignation at a meeting Feb. 6.

District spokeswoman Amy Higgins said Richardson last taught in the district on Jan. 8, the first day school resumed following winter break. That day, Richardson was placed on paid administrative leave after a female student alleged he inappropriately touched her. He never returned to the classroom.

“We immediately began an investigation that included the school administration, district administration and Elyria police. Lorain County Children Services was also contacted,” Higgins said. “The Elyria police investigation concluded nothing criminal or sexual happened, and Children Services did not feel their involvement was warranted further. But the teacher’s actions were inappropriate, unprofessional and did not reflect the behavior expected from all teachers and staff. When confronted, he chose to resign.”

Police Capt. Chris Costantino said detectives will continue to investigate any incidents reported to them and, if warranted, forward cases to the Lorain County Prosecutor’s Office.

District Human Resource Director Gary Taylor said Richardson has filed for unemployment and the district will dispute the claim.

“I can only assume he will argue he resigned because he was facing termination,” Taylor said.

Higgins said the district was prepared to terminate Richardson, in part because a history of incidents is documented in his personnel file.

In 2009, two female students went to then-Assistant Principal Joy Jones and then-school resource Officer James Homoki with allegations that in November 2008 and again in January 2009 Richardson physically touched one of the female students on her head and shoulder and peered down her shirt from behind, according to his personnel file.

The story was corroborated by another female student seated in an adjacent seat at the same table, a report of the incident said.

“Both students indicated their discomfort with this,” said a letter in Richardson’s personnel file.

The female student was transferred to a new class and Richardson received a two-day unpaid suspension. The district, according to a disciplinary action notation in his file, told Richardson his behavior rose to the level of sexual harassment.

“Mr. Richardson was advised that he is to cease any physical contact toward female students,” the letter said. It was signed by Taylor and the high school’s then-Principal Darren Conley.

Another letter in Richardson’s file detailed allegations from April 2003. Then-Principal Mike Gillam wrote in detail about classroom incidents that were reported to him.

“You physically grabbed a female student by the side, after a comment of “I am going to get you,” you began to tickle her,” the incident report said. “The student asked you to stop, which you did, a short time later. While student-teacher relationships are very important, this physical touching (tickling) is inappropriate and cannot occur again.”

The lengthy report also said Richardson — when dealing with another female student who was about to sit down on a book bag strap — grabbed the strap and said, “You do not want this to go up your anus.’’

In addition, Gillam said female students brought to his attention incidents when Richardson would send roses, purchase holiday gifts and write notes to female students signed, “Love.’’

“Flowers, personal gifts such as body lotions, etc … are not to be given to students,” Gillam wrote to Richardson in the letter. “The implication is that these gifts denote a relationship that could be more than student-teacher interaction. Cards that are signed “love,’’ or “I miss you,” imply more of the same.”

Gillam told Richardson not to give any current or former students or student aides gifts, to restrict use of student aides to times when he was teaching in a classroom and be limited to male students, according to the letter in Richardson’s personnel file.

Taylor said the 2003 incident was handled with a plan for corrective action and it — in and of itself — did not warrant termination.

Following the 2003 incident, Richardson submitted a rebuttal to be put in his file.

“The alleged actions, while taken out of context, may have shown some poor judgment on my part due to lack of experience,” it said. “There were never any intentions on my part to be disrespectful to any of my students or any motives beyond a teacher-student relationship. The gifts were simply an attempt to show appreciation for the hard work done by my student aides. I appreciate the administration bringing their concerns to my attention. I have become aware of how some of my actions might be perceived by some people the wrong way.”

Richardson received a bachelor’s degree in zoology from The Ohio State University in 1990 and his teaching certification from Cleveland State University in 2000, according to paperwork in his file.

He was a student teacher at Westlake High School before Elyria Schools hired him in 2000 as a science teacher.

Other incidents not related his conduct with female students, but noted in Richardson’s personnel file, include not signing student attendance forms, sending students to the media center when they should be in class, and being neglectful in his record-keeping.

    There has to be some way to prevent people accused of a crime from “resigning” their positions and moving freely to another job where they can possibly victimize more people. School boards need to “grow a pair” and stop accepting those resignations hold a disciplinary hearing. This guy apparently has a PATTERN of bad behavior and the INEPT school board let him walk.

    When it happens, it happens 99% of the time with UNION government employees.

    A TERMINATION speaks volumes to possible future employers.

        Government UNION employees nearly always get to resign instead of being terminated and we ALL know it in situations like this.

        This guy is now free to go elsewhere and apply for a job with no termination on record and a former employer too cowardice to inform any future employer of his behavior.

        While sexual harassment is not exclusive to government or union personnel, the unimaginable fact that they get to walk away from the situation unscathed and unpunished is PREDOMINATELY a union phenomenon.

            Many times an employee resignation ends all formal or informal inquiries into possible illegal/unethical activity.

            Too many times the schools and law enforcement take the easy way out, when it comes to possible future litigation.

            A friend of mine from LHS and before that, who went on to become a teacher but found himself without a job in the middle of the school year (not for wrong doing on his part (as far as I know)) lucked out and was hired in the middle of the year, to replace a high school teacher who had a crush on one of his students. Everyone knew about the love affair but didn’t care about how the fool would carry his “girlfriend’s” books down the hall like a love sick moron.

            What finally caught the attention of the authorities, to the point where ignoring the problem was an impossibility, was the parents of the girl complaining to the principal that one of his teachers knocked up their little girl.

            With all involved in a conference, including the cops, the teacher agreed to marry the hillbilly and quit his job.

            The school was happy because things were kept out of the public and there would be no law suit, cops didn’t care one way or the other, and the parents of the hillbilly girl, were of the opinion that their snaggle toothed little darling was unlikely to trap a university graduate any other way.

            My friend was especially happy to be working…

            So, by most f’ed up standards all ended well.

    The increasing inappropriate behavior between teachers and students, and coaches and student athletes, should alarm us all. My thought about the inappropriateness is the desire on the adults’ parts to be FRIENDS with the students to gain their trust instead of developing an appropriate teacher/student relationship which is business only in nature. Also a contributing factor is the manner of attire with the ultra-casual attire on both the part of the adults and students in a school atmosphere. While most schools now take some form of federal matching funds or state funding, it is still proper and appropriate to establish AND ENFORCE a dress code. Somehow, nobody’s civil rights are being violated in Cleveland Public Schools by requiring uniforms. Let’s start with a very focused orientation each and every year reminding teachers of their position of authority and their responsibilities in instructing and guiding students toward independent thinking and adulthood. It is never an authority person’s place to overstep that divide.

    About the comments…

    Brian (and Zen) you’ve obviously been had by a flamer. Brian, I see you do well-intentioned work in your community; however, as a PTA leader and father of a young boy at home you should be more careful on the internet with your identity (to set an example for the students: it is obvious your approach is one of ‘nothing to hide’ which is commendable).
    In a span of 20-30 minutes I was able to tell where you lived, what organizations and activities you are and have been involved in, the names and approximate ages of your children and the locations of the schools they attend and attended: in addition, your wife’s profession and the status of your relationship and ‘pre-history’ … also your high school and military career, jobs and general media exposure and perception in your community as well as a good understanding of your daily and weekly routines.

    Please don’t get me wrong, I am not ‘stalking’ anybody.

    Almost all of this information came from you and the information you publish openly online. The time it took me was simply due to the amount of reading involved – which was quite copious. In fact it was so staggering I created this account just to say this as a warning to you and others (the story came in one of my news feeds).
    I don’t know about you though Zen, or if you know him Brian and could speak to him (I get the feeling you would be the more rational), but you too have been taken for a ride by this flamer (possibly 2 in your case) and it’s your own fault I regret to say. You come off, and I’m just saying to let you know from a third person perspective, as a little paranoid, angry and, as I said, irrational. Your Avatar does not detract from that perception. Again, not a criticism just an FYI (like someone you don’t know telling you you have broccoli stuck between your teeth – my comments are well-intentioned).
    One thing I will agree with the flamer(s) and others about though Brian is that you sully your message with your generalisations about Unions. There are bad people in the Corps, but the Corps is not bad. There are abusive people in power, but that does not make their institutions corrupt. By repetitively saying phrases such as “99% of the time” you do no service to your arguments as you provide an apparently reflexive response/reaction rather than one supported by fact and verifiable numbers and sources.
    I hope you both appreciate the spirit with which this was written and see that the flamer(s) did you a favor by “exposing” before someone with a more nefarious intent “exploited”.

    Actually I was a flamer/stalker victim and have changed my account. I’d have just checked ‘private’ if I was fooling you. Certainly your mystical stalker (or is it mythical? I can’t remember, I have a lisp) is bright enough to do that if they’re bright enough to open multiple accounts. If you had looked at the other comments you’d have noticed as well that I was indiscriminate with the jibes – I had hoped to keep the love spreading yet I needn’t have worried with someone off their medication like you on the comment loop.
