Pizza delivery robber gets 12 years



ELYRIA — An Elyria man involved in the pistol whipping and robbery of a pizza delivery driver was sentenced this week to 12 years in prison.

Michael Moore pleaded guilty last month to aggravated robbery, tampering with evidence and other charges in connection with the Feb. 23 attack on Marco’s Pizza driver Steve Whitely, who is the nephew of Elyria Police Chief Duane Whitely.

Police reported that Moore used his phone to order pizza and then he and two others attacked the driver in the lobby of a Fourth Street apartment building. Whitely was struck with a pistol when he tried to stop the men from stealing his cell phone.

Moore, 21, and Andre Hopper, his 21-year-old co-defendant, were arrested a short time later, while the third man involved in the attack escaped and has not been arrested. Hopper is awaiting trial.

    Of all the people, the police chief’s Nephew. It probably would have not been that important to the police, but now family, that’s another thing. He got 12 years, of which he might do 4 years. We might be equal under the constitution, but in reality, it often depends on who gets attacked. One can assume he had a court appointed attorney, He should have hired Anthony Davis, the attorney who represented the Sheffield Village Council Woman who lied to the police. She got one sweet deal compared to others who face the law. It was good that they got him off the street.

    Picked the wrong target. But who cares, this guy is gone for awhile, at least.

    The fact he had a long criminal record did not help his case either.

    Got what he deserved.
